Gastrack provides a digital platform designed to facilitate gas distribution tracking, management, and operational efficiency across Africa. The Service includes web-based and mobile applications, APIs, analytics tools, and related support services.

The Service connects distributors, retailers, and logistics partners with a unified platform for real-time tracking, inventory management, delivery coordination, and performance analytics.

We strive to maintain service availability and reliability but make no warranties regarding uninterrupted access or error-free operation.

To access certain features of the Service, you may be required to create an account and provide accurate, complete, and current information.

You are responsible for maintaining the confidentiality of your account credentials and password. You agree to accept responsibility for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or any other breach of security.

Gastrack reserves the right to refuse service, close accounts, or remove or edit content at its discretion.

You agree to use the Service only for lawful purposes and in a manner that does not infringe upon the rights of others or restrict their use and enjoyment of the Service.

Prohibited behavior includes: harassment or causing distress or discomfort; transmitting obscene or offensive content; disrupting the flow of dialogue within our Service; attempting to gain unauthorized access; collecting or tracking personal information of others; spamming; phishing; providing false information; infecting the Service with malware; or violating any applicable law or regulation.

You are solely responsible for the content you upload, transmit, or otherwise make available through the Service.

You represent and warrant that you own or have obtained all necessary permissions for any content you submit, and that such content does not violate any third-party rights or applicable law.

Gastrack is not obligated to monitor user content but reserves the right to remove content that violates these Terms or applicable law.

To the maximum extent permitted by applicable law, Gastrack shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or in connection with the Service, even if Gastrack has been advised of the possibility of such damages.

The total liability of Gastrack for any claim arising out of or relating to these Terms or the Service shall not exceed the amount paid by you, if any, for accessing the Service in the twelve months preceding the claim.

Some jurisdictions do not allow the limitation of liability, so this limitation may not apply to you.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Gastrack makes no representations or warranties of any kind, express or implied, regarding the Service, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy.

Gastrack does not warrant that the Service will be uninterrupted or error-free, that defects will be corrected, or that the Service or servers are free of viruses or other harmful components.

You use the Service at your own risk, and you are solely responsible for any damage to your devices or loss of data resulting from your use.

The Service may contain links to third-party websites and services that are not controlled by Gastrack. We are not responsible for the content, accuracy, or practices of these external sites.

Your use of third-party websites and services is governed by their respective terms and conditions and privacy policies. We encourage you to review these terms before using any third-party service.

Gastrack does not endorse third-party websites or services and shall not be liable for any harm or loss resulting from your use of them.

If the Service includes paid features, you agree to pay all applicable fees according to the pricing plan you have selected. Fees are exclusive of taxes unless otherwise stated.

Gastrack may change pricing with reasonable notice. Your continued use of the Service after such notice constitutes acceptance of the new pricing.

All payments are non-refundable except where required by applicable law. In the event of billing disputes, you must contact us within thirty days of the charge.

While we implement reasonable security measures to protect user data, Gastrack cannot guarantee the absolute security of information transmitted over the internet.

You are responsible for implementing appropriate security measures on your end and maintaining regular backups of your data. Gastrack is not liable for data loss, corruption, or unauthorized access resulting from your failure to maintain adequate security practices.

Gastrack maintains automated backups, but users should not rely solely on these backups for data recovery.

Gastrack may suspend or terminate your account and access to the Service immediately if you violate these Terms, engage in illegal activity, or threaten the integrity or security of the Service.

You may terminate your account at any time by contacting us. Upon termination, your right to access the Service ceases immediately, though you may retain a copy of your data for backup purposes if permitted by applicable law.

Provisioners of the Terms shall survive termination of your account.

These Terms are governed by and construed in accordance with the laws of Nigeria, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall be subject to binding arbitration administered by a mutually agreed upon arbitrator or arbitration body, unless the dispute qualifies for small claims court.

You agree to attempt resolution through good-faith negotiation before pursuing formal dispute resolution.

You agree to indemnify, defend, and hold harmless Gastrack and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, your violation of any third-party rights, or your violation of applicable law.

This indemnification obligation shall not apply to the extent that Gastrack is solely responsible for the claim due to its negligence or willful misconduct.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, the provision shall be severed.

The remaining provisions shall continue in full force and effect. However, if the severed provision is essential to the substance of these Terms, the parties may terminate the agreement.

These Terms and any other policies, terms of service, or agreements referenced herein constitute the entire agreement between you and Gastrack regarding the Service and supersede all prior and contemporaneous agreements, understandings, and negotiations, whether written or oral.

If there is any conflict between these Terms and any other agreement you have with Gastrack, these Terms shall control unless the other agreement explicitly states that it supersedes these Terms.
